How Does Divorce Mediation Work?
Mediation is perhaps the most popular form of alternate dispute resolution (ADR), and it's not hard to see why. Mediation enables parties to actively pursue their best interests while simultaneously reducing the stress and expense of finalizing a dispute in court.
During mediation, both parties work with a neutral third party, the mediator, to negotiate equitable terms for their divorce.
Mediations can occur over one or multiple meetings, depending on the complexity of the case. For example, during a high-asset divorce where valuable assets are on the line or in a divorce that involves children, multiple sessions may be necessary to negotiate a fair outcome. However, if parties don't share children and agree on how to distribute their property, they may not need more than a single mediation session.
Parties can utilize mediation to reach an agreement on:
- Property division (including debt distribution);
- Child custody; and
- Child support.
Mediators cannot offer legal advice to parties. To obtain counsel during mediation, you need to hire your own mediation attorney.
Once both parties negotiate terms for their divorce that they concur are equitable, they can work with their attorneys and the mediator to draft an agreement. If a judge assesses and approves of the agreement they'll sign it, finalizing the divorce.
