What Will My Private Judging Case Look Like?

Typically, our private judging cases look something like this:
  • We meet with both parties to learn more about the case. Once we have a good idea of what we’re dealing with, we’ll collect disclosures from both parties. The disclosures let the public court overseeing the case know the parties intend to use private judging and the extent of the private judging arrangement.
  • We take some time to assess the case ourselves. This helps us work with clients to help them understand what they can expect from their private judging, and how they may wish to present their case to the judge.
  • We schedule a consultation with a private judge in our office. As a result, individuals who utilize private judging don’t have to go to court.
  • The private judge will hold a hearing and come to a decision. Once the private judge makes a judgment, they will submit their findings to the public court overseeing the case (usually the county court where one or both parties live). At this stage, the public court typically approves the private judge’s judgment and resolves the case.
When you use private judging, you and the other party will be able to choose not only the judge but also the extent to which their ruling is final. As a result, private judging is a great option for individuals who want their case to have a lower profile or want an alternative to other forms of dispute resolution that’s a bit more structured.
