California’s Property Division Process
The first thing required from couples wishing to divide their assets during a divorce or legal separation must do is to file a “Schedule of Assets and Debts.” This essentially is a list of everything the couple owns, both communal and individual. A Schedule of Assets and Debts must include all real estate possessions, including:

- Owned homes/apartments
This schedule is then used to determine the appropriate division of the assets based on a number of factors, including who made payments on a property. Likewise, any pre-nuptial or post-nuptial agreements, which protect the possession of certain assets, must be considered. The possession of any debts, such as home mortgage loans, will also come into play.
The value of these assets will then be used to determine a fair division. Spouses may be allowed to “buy out” the other in the event of a mutual ownership.
