  • You or your spouse have been in California for at least six months
  • The marriage only lasted five or less years
  • Neither you or your spouse owns real estate
  • Both you and your spouse want the marriage to end
  • You and your spouse both give up rights to alimony
  • You and your spouse have $38,000 or less in community property
